GENERAL INFORMATION AND TERMS OF SALE

All our tours are guaranteed with a minimum of two participants.

Please inform us, during the booking process, of any specific physical needs of the participants.

Pets are not allowed on our regular tours, but they are allowed on private tours which are organized to meet any special needs.

During the tour, the instructions provided by the guide must be followed.

Each tour includes: round-trip transfer service from the pick-up point indicated during booking, with a 9-seat minivan, a 7-seat jeep or a 4-seat SUV, a multilingual guide and everything indicated in "the tour includes" at the end of each tour description.

CANCELLATIONS, CHANGES AND LIABILITY

Up to 48 hours before departure there is no penalty; less than 48 hours before departure a 50% penalty applies; less than 24 hours and for no-show a 100% penalty applies.

Departure and arrival times are subject to change, up to a maximum of 30 minutes, even without notice, for technical reasons, traffic or other causes beyond our control.

In case of changes in schedule and/or itinerary due to circumstances beyond our control, no refund is provided. The organizers reserve the right to cancel the trip for reasons beyond our control, but the cost of the tour will be fully refunded.

Promotional packages: for promotional packages, cancellation is free up to 48 hours before the first tour if you decide to cancel all three bookings. For partial cancellations (one or two tours) the refund will be calculated by applying the full price to the remaining tours.

CANCELLATION POLICY FOR MULTI-DAY PACKAGE

MODIFICATION OR CANCELLATION OF THE TRAVEL PACKAGE BEFORE DEPARTURE

Before departure, the organizer or seller who, for reasons attributable to him or related to himself, needs to significantly modify one or more elements of the contract, shall immediately inform the user in writing, indicating the modification and the resulting price variation. If the user does not accept the proposed modification, he may alternatively exercise the right to recover the amount already paid or to benefit from a new travel package. The user may exercise the above rights when the cancellation depends on failure to reach the minimum number of participants provided for in the catalog or the out-of-catalog program. The parties understand that the right to a refund of amounts already paid arises following non-acceptance of substantial changes determined by events due to or connected to the tour operator; therefore, the right to a full refund is excluded if the change is the result of unforeseeable circumstances and the tour operator has paid or must pay third-party service providers an amount that cannot be claimed back. The right to compensation does not apply if the user has been informed in writing of the cancellation at least 20 days before the departure date.

WAIVER OR INTERRUPTION OF MULTI-DAY SAILING TOUR

If the renter(s) cannot depart, they must promptly notify the lessor who will retain: the deposit, if the notice is given before the balance; the deposit and the balance if the notice is given more than a month before departure. In case of interruption of the rental at the request of the renter(s), they will not be entitled to any refund. It is therefore recommended that the renter(s) take out personal cancellation insurance.

FAILURE TO USE MULTI-DAY SAILING TOUR

If, due to factors beyond the Skipper's control (for example, unfavorable weather conditions), the planned embarkation and disembarkation ports prove to be unreachable or unusable, the Skipper may decide on the most appropriate alternatives and will inform the renter(s) in good time. No damages or compensation may be claimed for such unforeseen events and related inconveniences. In case of breakdowns or unexpected failures that require a stop for repairs, the lessor undertakes to keep this period as short as possible. If the period does not exceed 48 consecutive hours, the renter(s) cannot request any refund. Otherwise, the lessor will refund each day not enjoyed beyond the aforementioned 48 consecutive hours, or, where possible, may grant an extension to the end of the contract equal to the period of non-use (beyond the 48 hours of downtime). The lessor assumes no responsibility for delays in departure or interruptions of navigation due to adverse weather conditions, contrary provisions of the maritime authorities or impediments of a personal nature of the renter(s). In such cases, the rental contract will still run and the total rental will remain acquired by the lessor.

CONSUMER'S WITHDRAWAL

The consumer may withdraw from the contract without any penalty in the following cases:

  • Price increase of more than 10%;
  • Significant changes — necessary for facts due to and/or connected to the organization, except in the case of unforeseeable circumstances — to one or more elements of the contract objectively configurable as fundamental for the enjoyment of the trip as a whole and suggested by the organization after the conclusion of the contract itself, but before departure and not accepted by the consumer.

In the above cases, the consumer may alternatively have the right to:

  • Benefit from an alternative travel package, at no additional cost or with the refund of any excess money if the second package has a lower value;
  • The refund of the price already paid. The refund must be made within seven working days from receipt of the request. The consumer must communicate his decision (to accept the modification or to withdraw) no later than two working days from the notification of the increase or modification. If there is no explicit communication within this period, the organizer's proposal is considered accepted.

In case of withdrawal by the consumer, outside any of the cases mentioned above, the individual cost of the operation, payment of the insurance coverage already requested at the time of conclusion of the contract, or other services already provided, and the penalty as indicated below will be charged:

Penalty as follows:

  • 30% of the package price up to 30 days before departure;
  • 50% of the package price up to 10 days before departure;
  • 75% of the package price up to 5 days before departure;
  • 100% of the package price up to 3 days before departure and in case of no-show.

No refund is provided if the customer withdraws 3 days before departure, in case of no-show or for interruption of stay.

The Company's right to compensate for any damages suffered, for any reason, for facts caused by the customer remains valid.

CHANGES AFTER DEPARTURE

If, after departure, the organizer cannot provide, for any reason — except for cases where the impediment depends on reasons attributable to the consumer or unforeseeable circumstances — an essential part of the services indicated in the contract, he must prepare alternative solutions, at no additional cost to the contractor and, if the services provided have a lower value than expected, refund an amount equal to the difference.

If no alternative solution is possible, or the solution prepared by the organizer is refused by the consumer for proven and justified reasons, the organizer will provide, at no additional cost, a means of transport equivalent to the original one envisaged for the return to the place of departure or to a different place possibly agreed, subject to availability of means and seats, and will refund the difference between the cost of the services provided and that of the services performed up to the time of early return.

SUBSTITUTIONS

The consumer may be replaced by another person provided that:

  • The organizer is informed in writing 4 working days before the scheduled departure date, simultaneously receiving the reasons for the replacement and the details of the transferee;
  • The transferee meets all the conditions to use the service (pursuant to art. 89 Consumer Code), and in particular the requirements related to passport, visa, and health certificates;
  • Following the replacement, the same services or different services may be provided;
  • The substitute reimburses the organization for all additional costs to proceed with the replacement, in the amount communicated before the transfer.

The transferor and the transferee are responsible for payment of the price and the amounts referred to in letter d) of this article.
